Terms of Use

These Terms of Use ("Terms") set out the agreement between you and the Elaine and Eduardo Saverin Foundation (EESF), a charitable trust established under the laws of Singapore, together with its affiliates and subsidiaries (collectively referred to as "Foundation," "we," "us," or "our"). These Terms govern your use of our websites, registration platforms, mobile applications, online portals, electronic forms, surveys, interactive exhibits, and any other digital or physical channel managed or operated by the Foundation (together, "Sites").

The terms "user," "you," and "your" refer to any individual or entity that accesses or uses the Sites. These Terms do not override or replace the terms of any separate agreement you may have entered into with us.

By accessing or using the Sites, you confirm that you have read, understood, and agreed to be bound by these Terms, as amended from time to time. This includes acknowledgement of the disclaimers and limitations of liability set out herein. If you do not agree to these Terms, or if they are not legally recognised in your jurisdiction, you should not use the Sites.

Use of the Site

The Sites are provided primarily for personal and non-commercial purposes, unless otherwise agreed with us in writing. You agree to comply with all applicable laws and regulations when using the Sites and not to use them for any unlawful, fraudulent, or prohibited purpose.

Intellectual Property

All materials made available on the Sites, including text, images, graphics, logos, videos, software, and data, are the property of EESF or our licensors, and are protected by copyright, trademark, and other intellectual property laws. Any reproduction, modification, distribution, republication, transmission, public display, performance, or creation of derivative works requires prior written consent from EESF.

User‑Generated Content (if applicable)

Where the Sites allow you to post, upload, or otherwise contribute content (such as comments, feedback, or files), you grant EESF a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, adapt, publish, distribute, and display such content in connection with our mission. You confirm that any content you provide does not infringe the rights of third parties, and is not defamatory, obscene, unlawful, or otherwise harmful.

Disclaimers; No Warranties

The Sites are provided on an "as is" and "as available" basis. EESF makes no express or implied warranties regarding the Sites, including but not limited to guarantees of merchantability, suitability for a specific purpose, non-infringement, accuracy, reliability, or availability. We cannot guarantee that the Sites will operate without interruption, errors, or exposure to viruses or other harmful elements. You use the Sites at your own risk.

Limitation of Liability

To the fullest extent permitted by law, EESF, including its trustees, officers, employees, partners, and affiliates, will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or use, arising out of or connected to your use of the Sites, even if we have been advised of the possibility of such losses. In all cases, our total liability to you shall not exceed the amount you have paid, if any, to access or use the Sites in the twelve (12) months preceding the claim.

Links and Third‑Party Sites

The Sites may include links to third-party websites, services, or resources that are not owned or controlled by EESF. We are not responsible for the content, terms of use, or privacy practices of these external sites. Accessing such links is done at your own discretion and risk.

Your use of the Sites is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, store, and share your personal information.

Modifications to the Terms

EESF reserves the right to amend or update these Terms from time to time. The "last updated" date at the top of this page reflects the most recent changes. Continued use of the Sites after changes are published constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Sites.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Singapore, without reference to its conflict-of-laws rules. Any disputes arising out of or relating to these Terms or the Sites shall be resolved in the courts of Singapore, to whose exclusive jurisdiction you hereby consent.

General Provisions

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full effect. These Terms, together with documents explicitly incorporated by reference (including the Privacy Policy), constitute the entire agreement between you and EESF concerning the use of the Sites, and replace any prior agreements or understandings.
